Firms petition Ugwuanyi regarding the demolition of a N1.3 billion factory by a former APC candidate for the Presidency.

Dezern Nigeria Ltd. and Legacy Paints Ltd. have petitioned Enugu State Governor Ifeanyi Ugwuanyi regarding the demolition of their factory, which has a market value of $1.3 million, by Barr. (Mrs.) Uju Ken-Ohanenye, a former APC presidential candidate.

The petition dated December 28, 2022 and addressed to the governor, was titled: “The pervading lawlessness and overbearing selfish influences of some individuals in public offices..”.

Writing through their counsel, Chukwuma Machukwu Umeh SAN, the petitioners said Mrs Ken-Ohanenye, on 22-4 December 2022, along with an APC youth leader and members of the APC youth wing in Enugu (armed with bulldozers) again demolished their rebuilt factory and reduced all the structures therein to the ground level.

They stated that all paints and chemicals were flushed on the ground sensitive equipment carted away by thugs who carried out the demolition.

The petitioners told the governor that the former APC presidential aspirant had in 2018, demolished all structures in the vicinity including their factory, and rendering the employees jobless.

The petitioners reminded the Governor that records of the State Government and Ministry of Land, Enugu State etc showed that in 2013, the Government of Enugu State validly granted Statutory Certificate of Occupancy (No. CAL/07566 dated 25th November 2013 and registered as No. 5 at page 5 Vol. 126, Land Registry, Enugu) for 99 years to Dezern Nig Ltd in respect of a commercial piece of land known and situate at Plot M4 Cattle Lairage Site, Emene, Enugu State.

“It is also in the records of your State Government that this Company duly applied and got the necessary factory buildings approval. “As a follow up, they in line with your State Government policy of encouraging indigenous industrialization of the State, immediately (with borrowed funds) constructed and established an ultra-modern paint manufacturing factory at a cost of N1billion” the petitioners wrote.

“Your Excellency, could your office reallocate a plot of land without revocation of the existing Statutory Certificate of Occupancy granted to another on same Plot?

“Could your office reallocate a plot of land to a private person when no court order transferred the plot from the current holder to another individual? the petitioners queried.

According to the petitioners, “the erstwhile APC Presidential aspirant Barr. (Mrs) Uju Ken-Ohanenye initially demolished the factory, all she floated around the Nigerian Police Force and State Security Services, was frightening them with the insinuation that she would soon come into mainstream of power having conceded the presidential candidature of APC to Sen. Bola Tinubu who would soon become the president of Nigeria come May 2023. We have written APC on this.

By the petition, their lawyer has appealed to the governor to end his governance of Enugu State with glorious exit and not to be cajoled or misled by inordinate persons.

Chukwuma Machukwu Umeh, also urges the governor to, “Instruct the Ministry of Justice to file back the withdrawn Appeal in respect of the land to the Court for proper prosecution.

“Refuse any application or pressure for your office to reallocate our clients’ plot to any person including the erstwhile APC Presidential aspirant, Barr (Mrs) Uju Kennedy-Ohanenye or her Company Kenuj Investment Limited and where inadvertently, any reallocation has been made or attempted to have been made, to immediately cancel same”.
