2023: Court denies Nwajiuba's petition against Tinubu, Atiku

Chukwuemeka Nwajiuba, a former Minister of State for Education, and the incorporated trustees of Rights for All International (RAI) filed a lawsuit against Bola Tinubu, a presidential candidate for the All Progressives Congress (APC), and Atiku Abubakar, a presidential candidate of PDP

The Federal High Court in Abuja threw out the suit, though.

Justice Inyang Ekwo refused to have jurisdiction over the case on Thursday because the plaintiffs didn't have the right to file the suit.

Justice Ekwo called the case "incompetent" and then threw it out. He also criticized RAI, which said it was a non-government group, for getting involved in politically motivated cases.

The judge said that by taking part in politically motivated cases and, by extension, partisan politics, RAI went beyond the goals for which it was registered by the Corporate Affairs Commission (CAC) under part of the Companies and Allied Matters Act (CAMA) and did things that were against public policy.

Justice Ekwo then went ahead and dissolved RAI and told the CAC to take over the group and deal with it according to the law.

In the lawsuit, Nwajiuba and RAI, among other things, tried to get rid of the primaries that made Tinubu and Atiku Abubakar the presidential candidates for the APC and PDP, respectively. They also asked the court to replace Tinubu with the ex-minister, who said he ran in the APC primary but didn't get any votes.

Before that, he had quit as minister after the Electoral Act was signed.
