In a ruling on Wednesday, Justice Bolaji Olajuwon said that there was evidence that the IGP had mostly followed the court's earlier order to bring back Patrick Okoli, a police officer who had been forced to retire.
In light of what happened, Justice Olajuwon said that the IGP's request to cancel the committal order "is worthy of sympathetic consideration."
"In light of the fact that the court's order has been mostly followed and that full compliance will be made sure of, the order commuting the applicant, IGP Usman Alkali Baba, is set aside," she said.
In his November 29 ruling, Justice Olajuwon found the IGP guilty and gave him a three-month jail sentence for not following the October 21, 2011 decision of the Federal High Court to reinstate Okoli.
Okoli was forced to retire from his job as a Chief Superintendent of Police (CSP) at the Bauchi State Command in 1992. This was done by the Police Council, which is now called the Police Service Commission (PSC). They said they did this because of Decree 17 of 1984, but the court overturned this decision in October 2011.
